Department for Transport (DfT) consultation - Section 19 & 22 permits

The UK Government has consulted on The use of section 19 and section 22 permits for road passenger transport in Great Britain. The consultation set out why and how they propose to amend legislation and guidance about who can operate public service vehicles (PSV) without a PSV operator licence, using the system of permits set out in sections 18 to 23A in the 1985 Transport Act. This legislation is not devolved to the Scottish Government.

The proposals affect the operating model that many community transport operators rely on. The consultation asked for views on the proposed changes and closed on 4 May 2018.

The final response to the consultation and revised guidance for permit issuers and holders were published on 15 March 2019.

Amended legislation comes into effect on 1 October 2019.

Humza Yousaf, previous Minister for Transport and the Islands responded to the consultation on behalf of the Scottish Government on 1 May 2018.

Michael Matheson, Cabinet Secretary for Transport, Infrastructure and Connectivity, wrote to Nusrat Ghani, Parliamentary Under Secretary of State, on 25 February 2019, on behalf of the Scottish Government, about the final consultation response.
